Welcome to mischu. These terms apply to your use of this website and to any order you place through it. By browsing this site or placing an order, you confirm that you have read and agree to these terms, together with our Privacy Policy, Refund Policy and Shipping Policy.

These details are provided in accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).
2. Who may buy from us
You must be 18 or older and legally able to enter into a binding contract to place an order. By ordering, you confirm that you meet these requirements and that the information you give us is complete and accurate.
3. Products, prices and availability
Products shown on this website are an invitation to do business, not an offer. We may change or withdraw the availability of any product at any time.
All prices are shown in South African Rand and include VAT where applicable. Delivery charges are calculated and shown separately at checkout, before you pay.
We take care to describe our products accurately. Images are illustrative, and roast profiles, packaging and origin details may vary between batches. Where a price or description is obviously incorrect, we are not obliged to supply at that price — we will contact you to confirm the correct price or cancel the order before proceeding.
4. Orders and acceptance
Placing an order and receiving an automated confirmation email does not mean we have accepted your order. A contract of sale comes into existence when we confirm acceptance to you, or when we dispatch the goods, whichever happens first.
We may decline an order where a product is out of stock, where payment is not authorised, where we cannot deliver to the address given, or where we reasonably suspect fraud.
5. Payment
Payments are processed by our third-party payment provider. mischu does not receive, process or store your card details at any point. Card information is transmitted directly to the payment provider over an encrypted connection and handled under their security standards. Your use of that service may also be subject to the provider’s own terms and privacy policy.
6. Delivery
Delivery areas, timeframes and costs are set out in our Shipping Policy, which forms part of these terms. Timeframes are estimates rather than guarantees, but we will tell you if we become aware of a material delay. Risk in the goods passes to you on delivery.
7. Cancellations, returns and refunds
Your right to cancel an order within seven days under section 44 of ECTA, and your rights in respect of defective goods under the Consumer Protection Act 68 of 2008, are set out in full in our Refund Policy, which forms part of these terms.
8. Intellectual property
All content on this website — text, photographs, graphics, logos, the mischu name and marks, and the arrangement of that content — is owned by or licensed to mischu and protected by South African copyright and trade mark law.
You may view, download and print content for your own personal, non-commercial use. You may not reproduce, republish, sell, licence, adapt or otherwise commercially exploit any part of this website without our prior written permission.
9. Acceptable use
You agree to use this website lawfully, and not to:
- use it in any way that is unlawful, fraudulent or harmful
- attempt to gain unauthorised access to the website, its servers or any data
- introduce viruses or other malicious code
- use automated systems to scrape, copy or monitor the website without our written permission
- use the website to advertise or solicit for any other business
We may suspend or end your access to the website where we reasonably believe you have breached these terms.
10. Links to other websites
This website may link to third-party sites. We do not control those sites, are not responsible for their content or privacy practices, and their inclusion does not imply our endorsement.
11. Availability of the website
We aim to keep this website available and working correctly, but we cannot guarantee that it will be uninterrupted or error-free. We may suspend, withdraw or change all or part of the website, including for maintenance.
12. Liability
To the fullest extent permitted by South African law, and subject always to your rights under the Consumer Protection Act, we are not liable for indirect or consequential loss arising from your use of this website.
Nothing in these terms excludes or limits our liability where it may not lawfully be excluded or limited, including liability for death or personal injury caused by unsafe goods or by our negligence.
13. Privacy and electronic communications
We process your personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (“POPIA”).
By using this website or emailing us, you consent to communicating with us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
14. Changes to these terms
We may amend these terms from time to time. The amended version takes effect from the date it is posted here, shown below. Your continued use of the website after a change means you accept the amended terms. Where a change is material, we will make reasonable efforts to bring it to your attention.
15. Governing law and complaints
These terms, and any transaction concluded through this website, are governed by the law of the Republic of South Africa.
If you have a complaint, please contact us first at info@mischu.co.za so we can try to resolve it directly. You keep your right to refer a consumer complaint to the National Consumer Commission or an accredited consumer ombud.
